Terms of Service

1. Acceptance of Terms
By accessing or using Gabble Tech Pvt Ltd (“Gabble”, “we”, “our”), you agree to these Terms. If you do not agree, you must not use the platform.
2. Description of Services
Gabble provides AI-powered tools for evaluating language performance, including writing and audio-based assessments for educational institutions and their students.
3. Business Accounts and Structure
- Gabble is a B2B platform where institutions create and manage accounts.
- Institutions may create and manage student accounts under their organization.
- Administrators are responsible for managing users, including adding or removing students.
- Institutions are responsible for all activity conducted under their accounts.
4. User Accounts
- Users must provide accurate information and maintain account confidentiality.
- Shared login access is not permitted.
- We reserve the right to suspend or terminate accounts for misuse, abuse, or violation of these Terms.
5. Credits and Usage
- The platform operates on a prepaid credit system.
- Credits are consumed based on the type of exercise, as specified at the time of purchase.
- Credits do not expire and may be carried forward.
- Credits are non-transferable between accounts.
- All purchases are final and non-refundable unless determined otherwise at our sole discretion.
6. Payments and Billing
- Payments are processed via third-party providers including Stripe and Razorpay.
- We are not responsible for payment processing failures or delays.
- We reserve the right to modify pricing at any time with reasonable notice.
7. AI-Generated Content Disclaimer
- AI-generated outputs may be inaccurate, incomplete, or biased.
- Results are for practice and informational purposes only.
- Gabble does not guarantee improvement in IELTS, TOEFL, or other exam outcomes.
- Users and institutions are responsible for reviewing and interpreting results.
8. Data and Content
- Students retain ownership of their submitted content.
- Institutions have access to and control over student data within their organization.
- We may process and analyze content to provide and improve services.
- We may use anonymized data to improve AI models.
- Data may be processed using third-party services.
9. Data Retention
We retain user data unless deletion is requested by the institution. Due to storage constraints, data older than 6 months may be deleted at our discretion.
10. Acceptable Use
- Use the platform only for lawful purposes
- Do not upload harmful or unauthorized content
- Do not reverse engineer or scrape the platform
- Do not misuse the system in ways that harm service integrity
11. Suspension and Termination
- We may suspend or terminate accounts at our discretion.
- No refunds will be issued for terminated accounts.
- Access to the platform may be revoked upon termination.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Gabble provides its services on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- Gabble shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or reputational harm.
- Gabble shall not be responsible for:
- Inaccuracies or limitations in AI-generated evaluations
- Exam results, academic performance, or admission decisions
- User reliance on outputs generated by the platform
- Service interruptions, downtime, or technical failures
- Aggregate Liability Cap:
Gabble’s total aggregate liability arising out of or relating to the use of the platform shall not exceed the total amount paid by the institution to Gabble in the two (2) months immediately preceding the event giving rise to the claim. - The limitations in this section apply regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.
13. Indemnification
The institution agrees to defend, indemnify, and hold harmless Gabble, its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Use of the platform by the institution or its users
- Violation of these Terms
- Misuse of the platform, including unauthorized or unlawful use
- Content submitted by users, including essays, audio, or other materials
- Any claim that user-provided content infringes third-party rights
Gabble reserves the right to assume exclusive defense and control of any matter subject to indemnification, and the institution agrees to cooperate with such defense.
14. Service Availability
We do not guarantee uninterrupted or error-free service.
15. Changes to Service
We may modify or discontinue any part of the platform at any time.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of Maharashtra, India. Disputes shall be resolved through arbitration in Maharashtra.
